RE: Revised Site Plan, SP1.1, and request for “Exemption”
Dear Christine,
Please find attached the Revised SP1.1, showing the extent of the Existing Site & Building,
and clearly noting all of the dimensions of the existing Site and Building.
Further, we are not requesting a change of Use, and we have confirmed that the Lot
was a conforming Lot and Use prior to the Site Plan Review Zoning Bylaw being
enacted, and under S 375-24.1 E (2), the Site Plan qualifies for an Exemption:
“(2) Non-conforming uses. The regulations of this article shall not apply to parking
or loading facilities in existence or for which building permits have been issued
before the first publication of notice of the Public Hearing of this article of the
Zoning Bylaw, provided such facilities conformed with all applicable regulations
in effect when established and provided the use of the structure served by the
parking facility does not change.”
