The relief being sought is 4.4’ setback from the side property line where 10’ is required. (Article 7, Section 375-7.4 D (4) (b) Setbacks) The property is located at 1 Willow Street in the Single Resident A District and identified on Assessor’s Map 143 Lot 120. Information is on file in the office of the Board of Appeals and may be seen upon request. As the Town Office Building is closed to the public during the COVID-19 emergency, and as the Governor has banned public gatherings during this emergency while allowing municipal boards to temporarily conduct their business through videoconferencing platforms, this public hearing will have no physical location but rather will only be held remotely through the Zoom application and will be accessible for live interaction by the petitioners and the public using the Zoom Meeting ID: 896 6969 8058 and Password: 516434 ADVERTISED: The Notice for public hearing was published in The Dartmouth Chronicle on Wednesday, January 6, 2021 and Wednesday, January 13, 2021 ABUTTER’S LIST: Robert Gardner, Jr. motioned to waive the reading of the abutter’s list into the record. The motion was seconded by Michael Medeiros and roll call vote; Robert Gardner, Jr.-yes, Michael Medeiros-yes; and Halim Choubah (yes). The motion passed unanimously. A certified abutter’s list is available for review in the office of the Zoning Board of Appeals. Chairman Choubah invited the Petitioner or representative to present the case. Evan Hanson, Petitioner stated he is requesting relief of 5.5’ to construct a 12’x30’ detached single car garage on the north side of the property. Chairman Choubah invited Board members for questions. Michael Medeiros asked the Petitioner what his intent was regarding the shed: remove it, relocate it. Mr. Hanson stated probably remove it, depending on how it is when he starts to take it apart. Michael Medeiros informed Mr. Hanson, that if he intends to use it, a condition will be placed that it be placed in accordance with the zoning by-laws that it has the appropriate side yard setbacks and advised Mr. Hanson to check with the Building Department. Chairman Choubah invited public comments. No public comments. Chairman Choubah asked if there were any further questions/comments from the Board members or the public. No further questions/comments. The Board made findings which are listed in the Decision. The Board made proposed conditions which are listed in the Decision. Michael Medeiros made the motion to close the public hearing for Case 2020-26. The motion was seconded by Robert Gardner, Jr. and roll call vote: Robert Gardner, Jr.-yes; Michael Medeiros-yes; Halim Choubah-yes. The motion passed unanimously. Michael Medeiros made the motion to approve VARIANCE Case 2020-26 in accordance with the Board’s stated findings and proposed conditions. The motion was seconded by Robert Gardner, Jr. and roll call vote: Robert Gardner, Jr.-yes; Michael Medeiros-yes; Halim Choubah-yes. The motion passed unanimously. Chairman Choubah asked for a motion to close the hearing on the case. Michael Medeiros made the motion to close the hearing on Variance Case 2020-26. The motion was seconded by Robert Gardner, Jr. and roll call vote: Robert Gardner, Jr.-yes; Michael Medeiros-yes; Halim Choubah-yes. The motion passed unanimously. 7:10 P.M.
