RE: Aquifer Variance Hearing for Plat 66, Lot 2-129, #6 Wren Lane
Dear Mr. &Mrs. McCormack:
At the Board of Health meeting held on April 7, 2004 in which you were in attendance, you
requested a variance from the Board of Health Aquifer Regulations Section 20.602 - the rendering
impervious of more than 10% of any lot in Aquifer Zone 2. The variance requested is to allow for the .
installation of a 27' round aboveground pool. The existing lot coverage is 13.99% or 3,288 square feet. A
27' aboveground pool will result in an increase of 2.41% impervious area or 16.4% impervious or 3,860
square feet impervious area.
The Board discussed this matter briefly and based on the aforementioned information, Gail
Davidson motioned to approve the Aquifer variance and Thomas Hardman seconded the motion and
then the Board approved the aforementioned to grant the aquifer variance. In addition, the Board of
Health considers aboveground pools temporary structures.

There was a Board of Appeals hearing open to the public held in MEETING ROOM #304,
TOWN OFFICE BUILDING, 400 SLOCUM ROAD, NORTH DARTMOUTH, MA, on Tuesday,
April 6, 2004 at 7:00 P.M. on the petition of Donald F. McCormack of North Dartmouth, who is
seeking a variance from the zoning bylaws of the Town of Dartmouth to allow the installation of a
27' round above-ground pool increasing the impervious area to 16.4% in the aquifer district for
property located on 6 Wren Lane, North Dartmouth in a Single Residence B District.(Sectiion-
20.608-increase of impervious in the aquifer district.).PLAT: 66, LOT: 2-129.
Present were Chairman Joseph L. Cosentino, William D. Whipp and Margaret A. Sweet.
DECISION
It was the unanimous decision of the Board of Appeals to GRANT the requested relief to
the petitioner, Donald F. McCormack to allow the increase in the impervious cover to 16.4% in
the aquifer district.
The Board found that the topography, soils and other characteristics of the site, because the
existing location of the dwelling and driveway remain without proposals the addition of the
above-ground pool an appropriate use.
The Board found that the limited nature of the construction indicates that there will be no
adverse impact on the aquifer or recharge area.
The Board found no evidence that the proposal will result in any adverse impact on the
existing or potential Town water supply.
The Board finds that, owing to conditions especially affecting the parcel, but not affecting
generally, the zoning district in which it is located, a literal enforcement of the provisions of the
ordinance or zoning bylaws would involve substantial hardship, financial or otherwise, to the
petitioners.
The Board finds that desirable relief may be granted in the matter without substantial
detriment to the public good and without nullifying or substantially derogating from the intent or
purpose of the zoning bylaws.
THE FOLLOWING CONDITIONS AND RESTRICTIONS SHALL APPLY:
1. The increase in the impervious cover shall incorporate the 27' above ground pool as
located on plan submitted and entitled "Sketch of existing conditions for Don McCormack, map
66, lot 2-129, 6 Wren Lane, Songbird Acres, Dartmouth, MA., dated 1/8/04" which has been
hereby marked"A"and made part of the Board of Appeals file.
No variance or special permit, or any extension, modification or renewal thereof, shall take
effect until a copy of the decision bearing the certification of the Town Clerk that 20 days have
elapsed and no appeal has been filed or that if said appeal has been filed, that it has been
dismissed or denied, is recorded in the registry of deeds for the county and district in which the
land is located and indexed in the grantor index under the name of the owner of record or is
recorded and noted on the owner's certificate of title.
If the rights authorized by a variance are not exercised within one year of the date of grant of
such variance they shall lapse; provided, however, that the permit granting authority in its
discretion and upon written application by the grantee of such rights may extend the time for
exercise of such for a period not to exceed six months; and provided, further, that the application
for such extension is filed with such permit granting authority prior to the expiration of such one
year period. If the permit granting authority does not grant such extension within thirty days of
the date of application therefor, and upon the expiration of the original one year period, such
rights may be reestablished only after notice and a new hearing pursuant to the provisions of this
section.
Copies of the complete minutes of this hearing are available, upon request, at the office
of the Board of Appeals:
The fee for recording or registering shall be paid by the owner or applicant.
Appeals, if any, shall be made pursuant to Section 17 of the Massachusetts General Laws,
Chapter 40A, and shall be filed within 20 days after date of filing of such notice in the office of
the Town Clerk.
