Bowden 569 Old Fall River Road N. Dartmouth, MA Dear Commission Members: Enclosed please find the Notice of Intent under the Massachusetts Wetlands . Protection Act for the referenced project. My client, Mr. John H. Bowden has unknowingly performed work as detailed on DWG. NOI 606-1, which falls under the jurisdiction of the Dartmouth Conservation Commission. Mr. Bowden obtained a building permit to construct a garage, striped the top soil and stockpiled it in the Buffer Zone on the edge of Vegetated Wetlands, constructed the garage partially in the Buffer Zone and has left conditions as they were at the time of being informed that a Notice of Intent was required in order for him to continue. The topographic survey of the current site conditions as shown on DWG. NOI 606-1 indicates that the building is placed between the undisturbed 100 foot contour of the preexisting lawn and the undisturbed 101 foot contour, which parallels and runs through a preexisting dirt road. The garage floor elevation is at 100. 27 feet, which lies between the two preexisting contours. From the facts that can be gathered from the undisturbed contours on either side of the building and verbally related recollections of Mr. Bowden it is indicated that preexisting topography was maintained. The garage is not water tight and rising flood water can easily enter the building at floor level. The combined affect of maintaining the preexisting topography and the open construction of a garage act to mitigate any adverse effects downstream due to a reduction in flood storage volume created by the foundation itself. On behalf of my client, we request permission to complete the regrading of the stockpiled soil and grass reseeding around the existing structure to approximate the preconstruction lawn conditions and meet the existing grade of the undisturbed lawn. The garage construction allows water to enter the building at slab level, therefore the flood storage characteristics of the site are virtually unchanged.
