Dear Mrs. Jenkins:
Please be advised that this office will take all necessary and available measures within the law to
assure compliance of any structures built within the Town of Dartmouth.
The Zoning By-law at section 4B.404A(enclosed) is clear as to setbacks required for your property.
You will not that your required setback from the R.O.W. on your property to dwellings or other
structures is sixty(60') feet.
Be assured that your neighbor has been advised by this office as to his requirements. I trust this reply
answers the questions you pose in you letter of July 25, 2001.

Dear Mr. Silveira,
We would like to ask that a determination be made for Bylaw 4B.404 Minimum
Setbacks. We, and Joel Reed (7/20/01) have been told by James Devlin, the owner of
1 Oakridge Drive, that he will be building an indoor arena. (no permit as of 7/20/01)
The property line stake shown to Mr. Reed was not surveyed by a licensed surveyor
and we would ask that the town not make any determinations of setback by this marker.
(see attached letter)
Also, the property line in question is a 50' R.O.W. for possible future development as a
road. (see deed and map for parcel located behind the properties) The question arises as
to whether there is to be a 20' setback or 60' setback.
We would like this determination with regards to the possible building on the adjacent
property and for our own purposes for future homes, buildings and their setbacks.

friend, (James Devlin), did survey a property line along a right of way for future
development, This survey was independent and not associated in any way with Roads
Corporation. We also told James Devlin we are not licensed land surveyors, therefore the
accuracy of our survey would have to verified by a licensed land surveyor.
